Cloudwifi, SL, in application of current regulations regarding the protection of personal data, informs that the personal data collected through the forms on the Website: https://cloudfibra.com, are included in the specific automated files of users of the services of Cloudwifi, SL.

The purpose of the collection and automated processing of personal data is the maintenance of the commercial relationship and the performance of information, training, advice, and other activities typical of Cloudwifi, SL.

These data will only be transferred to those entities that are necessary with the sole purpose of complying with the aforementioned purpose.

Cloudwifi, SL adopts the necessary measures to guarantee the security, integrity, and confidentiality of the data in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing the old LOPD, the new Organic Law 3/2018, of December 5, on Data Protection and Guarantee of Digital Rights (LOPDGDD).

The user may at any time exercise the rights of access, opposition, rectification, cancellation, limitation, and portability recognized in the aforementioned Regulation (EU). Purpose of the processing of personal data

For what purpose will we process your personal data?

At Cloudwifi, SL, we will process your personal data collected through the Website with the following purposes:

• To comply with the commercial, labor, corporate, and accounting obligations of the company.
• To provide its services according to the particular needs of the clients, in order to fulfill the contracts signed by it.
• To allow the client to pay amounts owed through the private area using a secure bank payment gateway. Payment data is processed directly by the corresponding financial institution, without Cloudwifi, SL storing the user’s bank information.
• For security or fraud prevention purposes.
• To allow the creation and management of the private client area, including authentication, access control, account administration, consultation of contractual information, billing, incident management, and maintenance of the contractual relationship.
• To attend to, manage, and respond to requests for information or communications sent by the user themselves through any of the contact channels enabled on the website.

We remind you that you can object to the sending of commercial communications by any means and at any time by sending an email to the address indicated above.

The fields in these records are mandatory, being impossible to carry out the stated purposes if these data are not provided.

For how long is the personal data collected kept?

The personal data provided will be kept as long as the commercial relationship is maintained or you do not request its deletion and during the period for which legal responsibilities could arise for the services provided. Likewise, we will keep your data as long as you do not object to the processing.

Legal Basis

The processing of your data is carried out with the following legal bases that legitimize it:

1. Compliance with legal obligations to fulfill the legal, tax, accounting, or administrative obligations corresponding to Cloudwifi, SL.
2. The request for information and/or the contracting of the services of Cloudwifi, SL, whose terms and conditions will be made available to you in any case, prior to a possible contracting.
3. Free, specific, informed, and unambiguous consent, while we inform you by making this privacy policy available to you, which after reading it, if you agree, you can accept by a statement or a clear affirmative action, such as checking a box provided for this purpose.

Origin of the data and method of collection

Recipients

Personal data may be communicated to the companies of the business group (Daw22, SLU, with NIF B54887732, Fiber Network Services, SL with NIF B13897814, Bravo Asset Management SL with NIF B42700757, Neutra Networks SL with NIF B72403520, and The Value Of Connection, S.L., with NIF B42690925) when such communication is necessary for the accounting consolidation of the group, the harmonization of corporate policies, and the exercise of strategic, commercial, and financial management functions.

The data will not be communicated to any third party outside Cloudwifi, SL, except under legal obligation.

Data collected by users of the services

In cases where the user includes files with personal data on shared hosting servers, Cloudwifi, SL is not responsible for the user’s non-compliance with the GDPR.

Intellectual property rights

Cloudwifi, SL is the owner of all copyright, intellectual property, industrial property, “know how”, and any other rights related to the contents of the website https://cloudfibra.com and the services offered on it, as well as the programs necessary for its implementation and related information.

Reproduction, publication, and/or non-strictly private use of the contents, in whole or in part, of the website is not allowed without prior written consent.

Intellectual property of the software

The user must respect third-party programs made available by Cloudwifi, SL, even if they are free and/or publicly available. Cloudwifi, SL has the necessary exploitation and intellectual property rights for the software.

The user does not acquire any right or license for the contracted service, over the software necessary for the provision of the service, nor over the technical follow-up information of the service, except for the rights and licenses necessary for the fulfillment of the contracted services and solely for the duration thereof.

For any action that exceeds the fulfillment of the contract, the user will need written authorization from Cloudwifi, SL, and the user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of the servers owned by Cloudwifi, SL, assuming civil and criminal liability derived from any incident that could occur in the servers and security systems as a direct consequence of negligent or malicious action on their part.

Intellectual property of hosted content

Use contrary to the legislation on intellectual property of the services provided by Cloudwifi, SL is prohibited, and in particular:

• Use that is contrary to Spanish laws or that infringes the rights of third parties.
• The publication or transmission of any content that, in the opinion of Cloudwifi, SL, is violent, obscene, abusive, illegal, racial, xenophobic, or defamatory.
• Cracks, serial numbers of programs, or any other content that violates the intellectual property rights of third parties.
• The collection and/or use of personal data of other users without their express consent or in contravention of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council.
• The use of the domain’s mail server and email addresses to send unwanted mass mail.

The user has full responsibility for the content of their website, the information transmitted and stored, hypertext links, third-party claims, and legal actions regarding intellectual property, third-party rights, and protection of minors.

The user is responsible with respect to the laws and regulations in force and the rules that have to do with the operation of the online service, electronic commerce, copyright, maintenance of public order, as well as universal principles of Internet use.

The user will indemnify Cloudwifi, SL for the expenses generated by the imputation of Cloudwifi, SL in any cause whose responsibility was attributable to the user, including legal defense fees and expenses, even in the case of a non-final judicial decision.

Protection of hosted information

Cloudwifi, SL makes backups of the content hosted on its servers; however, it is not responsible for the accidental loss or deletion of data by users. Similarly, it does not guarantee the total replacement of data deleted by users, since the aforementioned data could have been deleted and/or modified during the period of time elapsed since the last backup.

The services offered, except for specific backup services, do not include the replacement of the contents preserved in the backups made by Cloudwifi, SL, when this loss is attributable to the user; in this case, a fee will be determined according to the complexity and volume of the recovery, always with prior user acceptance.

The replacement of deleted data is only included in the price of the service when the loss of content is due to causes attributable to Cloudwifi, SL.

Minors

Minors under eighteen (18) years of age must request and obtain the permission of their parents, guardian, or legal representative before accessing the content hosted on the PORTAL. Access and use of the portal by unauthorized minors under 18 years of age is prohibited.

Cloudwifi, SL reminds legal age users who are in charge of minors under 18 years of age that it will be their sole responsibility to determine which services and/or contents are appropriate for the latter; and informs them about the existence of computer programs to limit navigation, by filtering or blocking certain content.

Commercial communications

In application of the LSSI, Cloudwifi, SL will not send advertising or promotional communications by email or other equivalent electronic communication means that had not previously been requested or expressly authorized by the recipients thereof.

In the case of users with whom there is a prior contractual relationship, Cloudwifi, SL is authorized to send commercial communications referring to products or services of Cloudwifi, SL that are similar to those that were initially the object of contracting with the client.

In any case, the user, after proving their identity, may request not to receive further commercial information through the Customer Service channels.
